Terms of service

1. General

These terms govern training and consulting services provided by Dmytro Sviridov BERSERK, ul. Jana Kazimierza 50/23, 01-248 Warsaw, Poland, NIP 9452258919, REGON 522599719 (the Provider), and the use of berserkdev.com.

2. Scope of services

The Provider offers:

firearms courses and training delivered at ranges compliant with Polish law
preparation for the shooting patent and PZSS exams
informational consulting on the path to a Polish firearms licence (not legal services)
training, events and consulting for companies and organisations

3. Booking and payment

Bookings are accepted by phone and through Telegram. The price is agreed individually before the session and confirmed in writing. Payment is made by bank transfer or in cash. An invoice is issued on request.

4. Cancellation and rescheduling

A session can be cancelled or moved free of charge no later than 48 hours before its start. Later cancellation may result in retaining a deposit covering costs already incurred (range slot, ammunition). The Provider may cancel a session due to weather, facility failure or force majeure — in that case a new date is offered or the payment is refunded.

5. Safety and exclusion from a session

Participants must follow the range regulations and the instructor at all times. A person may not take part if they are:

under the influence of alcohol, drugs or medication affecting concentration
a minor without a legal guardian present and written consent
in a state of health that prevents safe participation
breaching safety rules — the instructor ends the session without a refund

6. Liability

The Provider is responsible for the correct and safe conduct of sessions and for the condition of the equipment provided. The Provider is not liable for damage caused by a participant breaching range regulations or instructor commands, or by withholding health information.

7. Complaints

Complaints can be sent to dmytrosviridov@gmail.com within 14 days of the service. A reply is provided within 14 days of receipt.

8. Right of withdrawal (consumers)

A consumer who concluded a distance contract may withdraw within 14 days without stating a reason. The right does not apply to contracts for leisure services where the contract specifies the day or period of performance (Article 38(12) of the Polish Consumer Rights Act), nor where the service has been fully performed with the consumer express consent before the deadline.

9. Out-of-court dispute resolution

Consumers may use out-of-court procedures, including mediation at the Provincial Trade Inspection Authority and the European Commission ODR platform. Use of these procedures is voluntary.

10. Personal data and final provisions

Data processing is described in the Privacy policy. Polish law applies to matters not covered here. The Provider may amend these terms, publishing information on the site; bookings made before an amendment are governed by the version in force at the time of booking. The Polish version of these terms is the binding one.
